Terms and Conditions of Sale

These Terms and Conditions of Sale govern solely the advisory service, preparatory logistical support and language brokering provided by the publisher of the site sonkulhorses.fr (hereinafter “the Provider”) to any customer (hereinafter “the Client”) wishing to prepare a trip or a horse trek in Kyrgyzstan with the independent local guide Azamat.

Placing an order or paying a service fee on the Site means the Client accepts these Terms in full and without reservation.

• What the Provider sells: The Provider sells an intellectual and online service (preparation advice, logistical expertise, translation, help getting in touch with the local guide). Any amount paid online corresponds strictly to that service and introduction fee. Under no circumstances is it a deposit (acompte), earnest money (arrhes) or a part-payment for the horse trek.
• What Azamat does: The organisation, management, sale and running of the riding service (horses, yurt accommodation, meals, guiding) are carried out entirely independently by Azamat, a local guide based in Kyzart, Kyrgyzstan.
• Not a travel agency: The Provider is neither a tour operator nor a travel agency within the meaning of the French Tourism Code (Code du tourisme). It plays no part in the sale of the final tourism service, which is the subject of a direct agreement between the Client and Azamat.

• The Provider's prices: The prices of the advisory and introduction services are shown on the Site in euros. Any payment made online covers exclusively the preparation, language support and logistical facilitation carried out beforehand from France.
• Payment methods: The service fee is paid by bank card through the secure payment solutions built into the Site.
• Paying for the service on the ground: The cost of the horse trek itself is set by Azamat and must be paid directly to him on the terms agreed with him, with no financial or commercial involvement from the Provider.

In accordance with article L. 221-28 of the French Consumer Code (Code de la consommation), where the advisory and introduction service has been fully performed, or where the introduction details have been passed on before the end of the withdrawal period with the Client's agreement, the service fee paid to the Provider is not refunded if the Client cancels the trip.

The terms for cancelling, postponing or refunding the local horse trek are governed solely by Azamat's own policy, which the Client is invited to clarify directly with him.

Riding at high altitude (up to around 3,400 metres at Lake Son Kul) carries inherent risks (falls, weather conditions, remoteness). By using the services of the Site, the Client undertakes to:

• Take out personal travel insurance that covers, without fail, equestrian sports in remote areas, medical costs and medical repatriation.
• Be in physical condition suited to riding in the mountains.
• Follow to the letter the safety instructions given on the ground by Azamat.

The Client is solely responsible for completing every formality their trip requires (passport validity, obtaining a visa or meeting the visa-exemption conditions for Kyrgyzstan, vaccinations, international flights). The Provider cannot be held liable for denied boarding or refused entry into Kyrgyzstan.

• The Provider's liability: The Provider's liability is strictly limited to the proper performance of its advisory and introduction service. It can under no circumstances be engaged where the horse trek is poorly performed, changed, delayed or cancelled on the ground, nor in the event of an accident, injury, theft or financial dispute arising between the Client and Azamat.
• The relationship on the ground: Any contract or agreement relating to the riding trip is entered into at the Client's own risk, directly with the Kyrgyz provider, under local law and local practice.

The information collected at booking (name, contact details, preferred dates, riding level) is passed on to Azamat so that he can arrange the Client's stay. It is processed in accordance with the Site's legal notice and with the regulations in force (GDPR). The Client has a right to access, correct and delete their data by contacting: contact@sonkulhorses.fr.

These Terms are governed by French law in everything concerning the advisory service and the use of the Site. In the event of a dispute over their interpretation or performance, and failing an amicable settlement, exclusive jurisdiction is granted to the competent French courts. Disputes inherent to the performance of the tourism service in Kyrgyzstan fall exclusively to the competent local courts.
